Ekiti man who killed his sibling over father's property to pass on by hanging

  An Ekiti State High Court in Ado Ekiti has condemned 49-year-old Akinola Ademola to death by hanging.

  He was summoned before Justice Lekan Ogunmoye in December 2020 for offenses of outfitted burglary and murder, of his senior sibling.

  The charge peruses, "that Akinola Ademola, on nineteenth of November 2019 at Usin Ekiti in Ikole Local Government Area of Ekiti State, inside the ward of this fair court, denied one Akinola Tunde of his Bajaj Motorcycle with Registration number ADK 011 VC, at the hour of the burglary, you were furnished with a hostile weapon, indeed; firearm.

  "On same date, general setting killed the person in question, Akinola Tunde."An observer, Ogunnusi Anike, who affirmed under the steady gaze of the court said, "myself and the departed were on the homestead, going on a pathway, the departed was riding his Bajaj bike while I was journeying in light of the fact that the trail was exceptionally unpleasant, out of nowhere, I saw someone inside hedge pointing a weapon at the departed, I yelled, "Tunde, Tunde, run, run, someone is pointing a firearm at you", then, at that point, I fled. While running, I heard a shot, I later saw a bystander out and about, and when I made sense of what befell him, he went with me back to the scene, on arriving, we met the departed face down in the pool of his blood, his bike had been removed by an obscure individual."

  Another observer affirmed, that the departed and his more youthful sibling once had a quarrel on the administration of their dads' homestead properties and during the police examination, the departed's bike was found in his more youthful sibling's ownership, he had changed the number plate yet the disclosure was made through the cruisers' records.

  As indicated by the arraignment, the offenses negate areas 402 (2) and 319(1) of Criminal Code Law, Cap C16, Laws of Ekiti State of Nigeria, 2012.

  To demonstrate his case, the examiner, Barrister Kunle-Shina Adeyemi called four observers, he offered proclamations of the observers, explanations of the litigant, two privately made weapons, a photo of the respondent presenting with the bike, cruiser points of interest, and a clinical report, among others as shows.

  The respondent talked in his own safeguard through his advice Olarewaju Oluwasola and called no observers.

  In his judgment, Justice Lekan Ogunmoye said the elements of the offenses of outfitted burglary and murder had been laid out against the respondent, subsequently, suggesting that the charge of equipped burglary and murder had been demonstrated for certain against the litigant.

  "Altogether, the arraignment had prevailed with regards to persuading the court to determine the sole issue for assurance in support of himself and I so do.

  "The respondent is as needs be indicted as charged for the offenses of furnished burglary and murder.

 "The respondent is condemned to death by hanging in count one (Armed Robbery) and count two (Murder) until he be dead, may the Lord show kindness toward your spirit," he said.
